1. Purpose of the Contract

These Terms and Conditions govern the booking and use of services offered by Bellini Luxury Yacht, operating in Tenerife, for private cruises, bespoke experiences, and any additional requested services.

2. Bookings

• Bookings are only considered confirmed upon receipt of the deposit payment indicated in the booking confirmation.
• The total balance must be paid no later than the date stated in the booking confirmation.
• For extra services (e.g., private chef, water activities, transfers), bookings are subject to availability and written confirmation.

3. Prices and Payments

• Prices include the services described in the offer or on the official website, including VAT/IGIC unless otherwise stated.
• Any additional hours, extra consumptions, or services not included will be charged separately and must be paid onboard or according to the agreed terms.
• Accepted payment methods include bank transfer, credit card, or other approved methods.

4. Cancellations and Refunds

• Cancellation by the client:
  • Up to 15 days before departure: 100% refund of the amount paid.
  • From 14 to 7 days before: 50% cancellation fee.
  • Less than 7 days before: 100% cancellation fee, no refund.
• Cancellation by Bellini Luxury Yacht:In case of bad weather, technical issues, or other force majeure events, the trip may be rescheduled or fully refunded at the client’s discretion.

5. Weather Conditions and Safety

• The captain reserves the right to modify the itinerary or cancel the trip for safety reasons.
• All passengers must follow the crew’s instructions during navigation and activities.

6. Use of the Yacht and Onboard Conduct

• Smoking is prohibited inside enclosed areas of the yacht.
• Carrying illegal or dangerous substances onboard is strictly forbidden.
• Any damage caused by passengers will be charged directly to the booking holder.
• Children must be supervised by an adult at all times.

7. Extra Services and Water Activities

• All extra activities must be booked in advance and are subject to availability.
• Some activities (e.g., diving, flyboarding) may require specific certifications or physical conditions.
• Bellini Luxury Yacht is not liable for accidents during activities managed by third-party providers.

8. Liability

• Bellini Luxury Yacht ensures the yacht complies with current maritime regulations.
• The company is not responsible for the loss of personal belongings, indirect damages, or delays caused by events beyond its control.

9. Governing Law and Jurisdiction

• These Terms and Conditions are governed by Spanish law.
• Any dispute shall be submitted to the court of Santa Cruz de Tenerife.

10. Acceptance

By confirming the booking, the client declares to have read, understood, and fully accepted these Terms and Conditions.

1. Objeto del contrato

Los presentes Términos y Condiciones regulan la reserva y el uso de los servicios ofrecidos por Bellini Luxury Yacht, con base operativa en Tenerife, para cruceros privados, experiencias personalizadas y servicios adicionales solicitados.

2. Reservas

• Las reservas se considerarán confirmadas únicamente tras la recepción del pago del depósito indicado en la confirmación de la reserva.

• El importe total deberá abonarse a más tardar en la fecha indicada en la confirmación.

• Para servicios extra (por ejemplo, chef privado, actividades acuáticas, traslados), la reserva está sujeta a disponibilidad y confirmación por escrito.

3. Precios y pagos

• Los precios incluyen los servicios descritos en la oferta o en el sitio web oficial, impuestos incluidos (IVA/IGIC)salvo indicación contraria.

• Las horas adicionales, consumiciones extra o servicios no incluidos se cobrarán por separado y deberán abonarse a bordo o según las condiciones acordadas.

• Métodos de pago aceptados: transferencia bancaria, tarjeta de crédito u otros métodos aprobados.

4. Cancelaciones y reembolsos

• Cancelación por parte del cliente:

  • Hasta 15 días antes de la fecha de salida: reembolso del 100% del importe pagado.

  • De 14 a 7 días antes: penalización del 50%.

  • Menos de 7 días antes: penalización del 100%, sin reembolso.

• Cancelación por parte de Bellini Luxury Yacht:

  En caso de mal tiempo, problemas técnicos u otras causas de fuerza mayor, la salida podrá reprogramarse o reembolsarse íntegramente a elección del cliente.

5. Condiciones meteorológicas y seguridad

• El capitán se reserva el derecho de modificar el itinerario o cancelar la salida por motivos de seguridad.

• Todos los pasajeros deberán seguir las instrucciones de la tripulación durante la navegación y las actividades.

6. Uso del yate y conducta a bordo

• Está prohibido fumar en las zonas cerradas del yate.

• Está prohibido llevar a bordo sustancias ilegales o peligrosas.

• Cualquier daño causado por los pasajeros será cargado directamente al titular de la reserva.

• Los menores deberán estar siempre bajo la supervisión de un adulto.

7. Servicios extra y actividades acuáticas

• Todas las actividades extra deberán reservarse con antelación y están sujetas a disponibilidad.

• Algunas actividades (por ejemplo, buceo, flyboard) pueden requerir certificaciones específicas o condiciones físicas determinadas.

• Bellini Luxury Yacht no se hace responsable de accidentes ocurridos durante actividades gestionadas por proveedores externos.

8. Responsabilidad

• Bellini Luxury Yacht garantiza que el yate cumple con la normativa marítima vigente.

• La empresa no se hace responsable de la pérdida de objetos personales, daños indirectos o retrasos causados por eventos fuera de su control.

9. Ley aplicable y jurisdicción

• Los presentes Términos y Condiciones se rigen por la ley española.

• Cualquier disputa se someterá a los tribunales de la Provincia de Santa Cruz de Tenerife.

10. Aceptación

Con la confirmación de la reserva, el cliente declara haber leído, comprendido y aceptado íntegramente los presentes Términos y Condiciones.
